I don't think so : that a Unicode-savvy parsers will handle gracefully the BOM.

As an example, I think that Smile (which includes many things including a XML parser) writes the BOM if you change a UTF-8 file where it first detected the BOM when opening.

yes but smile is applescript and applescript and utf-8....

even AppleScript Studio doesn't work really with utf-8 encoded applescript files...
