The second resolves because you are not resolving an alias.  path to startup disk as text returns just that text.

Now if you were to try this 

alias ((path to startup disk as text) & "this file does not exist")

then yes it would fail.

This does compile, but I would have expected it to have the same compile error as the above code:

(path to startup disk as text) & "this file does not exist"

How come?
