I can get the path to desktop the following way:
set mypath to path to desktop

In UNIX it would be set mypath to "/"

But I assume you tried that. The root is also the highest level directory on the startup disk.

set foo to "/" POSIX file foo --> file "Dora"

path to startup disk
--> alias "Dora:"

POSIX path of "Dora"
--> "/"
