alias list error

Can someone explain how I can fix this statement so that it works every time.
Right now, it works if there are two or files in the folder, but fails if only a
single file exists.

Here is the line:

set theList to (every item of folder hold_folder whose kind is not "folder") as alias list

and here is the results from the Event Log:

tell application "Finder"
get every item of folder "HD1:Infomac: Hold:" whose kind ≠ "folder"
{alias "HD1:InfoMac: Hold:auv4n0140.txt"}
"Can't make alias \"HD1:InfoMac: Hold:auv4n0140.txt\" into type «class alst»."
