I don't have this immediately handy but theres two properties you need to set for a background application. One of the com.apple variety and one LS. There are some notes on this not working completely correctly in the 10.2 release notes. That might mention the properties as well. Otherwise you can check the XAEServer.app for my Combined application. I have found it useable. Sometimes you get the dock icon sometimes not. This might be what is not working. Sometimes I double click launch, sometimes I LaunchServices launch from another application. That I think figures into when I get the icon.

OT I've been trying to think of a better name for my Combined application lately, kind of considering Cheese Wrapper at the moment. Most of my inspiration for these seems to come from Greg Guerin on these. I really liked Kluge Hammer which he mentioned once but figured that one was just too good to just steal.
