Even if the hardware still supports overlay planes, I doubt that the OS will give you access to them, and even if the OS did, it wouldn't fit in with the way things are composited together in Quartz.

Is there something in particular you are wanting to do with a hardware overlay plane that you can't do by overlaying an alpha composited OpenGL context and/or using an overlay window?
