It should still be avoided so the fact that it may no longer barf
all over itself is moot.

I've followed discussions on this topic for a while now but maybe I
missed something since I always thought the main problem with rsync
in tiger was EAs. And it's supposed to be fixed now.
That is just *a* problem, of which there are many. If it were just a
matter of EAs or ACLs those always worked.
Yet another example of why rsync should be avoided is that it uses
the brain-damaged copyfile()
