I must admit that I don't know all that much about the licensing issues, what I know is based on the articles I read on the mpegif site.
I agree with you that it seems that the MPEG-LA terms are finalized, and seem reasonable on first sight. I should have specified in my earlier message that it appears that Via is the problem, and I base this on the article at http://www.eet.com/sys/news/OEG20031119S0020
This ends with the statement:
"Now that terms from both licensing agencies are public, negotiations among patent holders and licensees are likely to start. We will continue to meet with the companies attending our program, Moore said. Via remains on schedule, with a plan to complete its patent license agreement by early 2004. "
And until the licensing agreements are finalized, I doubt any big "playmakers" are going to start using H.264 in more than isolated circumstances (i.e.-Polycom's hardware codec), and certainly not in mass distribution.
And it sure would be nice to have a "one stop shop", rather than two separate licensing schemes.
So, the above article is what I based my comments on, and not first-hand knowledge.
