One way around this is to inhibit the 'initial' xterm by
defaults write org.x.x11 app_to_run 'true'
then start xterms from the X11 Menu.

This has been the case since Leopard's X11 came out, through all the
versions and in 2.3.1_rc1. It's only a mild annoyance to me (I tend to
remember what I'm doing in xterms based on the command-key that
brings them
forward, and so hitting command-N a bunch of times and then having
to close
the first couple is a bit of a pain, but the deeper implications may
be
worth considering.
