That's just silly. IANAL but the license clearly states, "The output from running a covered work is covered by this License only if the output, given its content, constitutes a covered work." That would include the output of gcc.


Unless Apple were including gcc itself on the iPod (or similar) _and_ not allowing users to change gcc specifically, Apple would not be in violation of any version of the GPL including version 3 (which I finally just read as a result of your email).

In my opinion, the GPL is the most restrictive and least permissive open source license (don't send me mail telling me how wrong I am on this point, I'm not interested), but let's not misrepresent what it actually allows or disallows.
