The following causes an error in 10.5, has anybody run into this yet and do you know how to get around it?

set thePosixPath to "/path/to/application"
tell application "System Events"
if "AddLoginItem" is not in (name of every login item) then
make login item at end with properties {hidden:false, path:thePosixPath}
end if
end tell

NDA. You need to stop now.

You can file a bug with Apple, but you cannot discuss Leopard in a public forum (especially one hosted by Apple).
