Can't you test if the html file already exists?
If it does, rename it something like Acme-Sales-2007-05-old.html

So you will be able to save the new one.

I'm not accustomed to TextEdit scripting so, I don't know if there is a way to rename the active document on the fly. If it can be done, if Acme-Sales-2007-05.html already exists, try to rename the open doc Acme-Sales-2007-05#1 and save it as Acme- Sales-2007-05#1.html
