My bad folks... 

Helps when I read the message slowly.  Compile: Yes  Run: No.

My guess would be that because at compile path to startup disk is not being evaluated for path simply that the statement is valid.
This way you could compile a script to distribute to machine with varying HD names.  A hard coded path though is just that
hard coded and static.  Because of this the path is evaluated at compile since it will never change. 

That would be my thought anyways.

(path to startup disk as text) & "this file does not exist"

How come?
