I see this problem with many apps. At this moment I can't remember which ones, but I'm 99% sure that some are Apple apps. I'd suggest filing a bug, because it's very annoying that a backgrounded app has the ability to cover foreground app windows with its own windows, and the foreground app windows stay active, yet the new front window shows up as inactive. That's totally wrong. The Window Manager should prevent that.
