You need to use Compositing mode (which requires 10.2).

is there no other way to but a image in the background? i tried quickdraw, but when i hide the window the image is not showen anymore.

If you don't use Compositing Mode then you have the issue of the button erasing when it redraws itself, which will take out part of the picture. You could patch out one of the QuickDraw bottlenecks (which I'm not familiar with) to prevent the erasure, but in the end it's far easier (and far less code) to use Compositing mode.
