FSPathMakeRef volume case dependent

On OS 10.3
FSPathMakeRef will fail given
/volumes/GEORGE/
if the name of the volume is
george
(lowercase)
The error returned is -35
Volume names are not case dependent on OS 9.
No other component of a file name is case dependent
on OSX.
Is this a bug or a "feature"?
I have a workaround but it is rather ugly and time
consuming.
Will this non-feature be changed in a future OSX version?
