ApplePMU and open source

I understand that the current version of the ApplePMU driver is not open source. Can anyone comment on whether this is likely to change or not (or simply what the reason for it is)?

The reason I ask is that the most recent version of ApplePMU (1.2.4d1) panics on Kanga (I've sent the backtrace to the list previously). However, version 1.2d2 (and earlier) work fine (well, at least they don't panic). Ideally, this is the sort of thing I'd like to fix, but it is difficult without source.

There is old source for ApplePMU in the CVS repository, from the days when it was compiled into the kernel instead of as a kernel extension. So I could start from that and see what happens. But if there is some prospect that ApplePMU might be made open source, I would prefer to work with the more recent code.
