Yet. I don't doubt that they soon will, given the way that Apple has thrown taste and simplicity out the window and is adopting it *everywhere*, even those places where the Aqua Guidelines didn't used to permit it.

Avoid using the textured window appearance in applications or utilities
that are unrelated to digital peripherals or to the data associated
with these devices.

Unless "data associated with these devices" means "files that might (or might not) be stored on an iPod", the Finder is squarely in the "avoid" camp, but Apple's shoving brushed-metal down our throats anyway. (Well, it wouldn't be the first time the Aqua Guidelines were rewritten to match whatever Apple wanted to do that month.)
