The notice said "Copyright Smartspread", not "Copyright <programmer's name>". Hence, only a legal representative of Smartspread can give permission for others to use the code. I would assume that a programmer is *not* a legal representative unless I saw some evidence otherwise. As well, had the code been *intended* for public use, it would have been easy enough to strip off the copyright notice. It's as reasonable to assume that the copyright is being retained as it is to assume that the notice was left by accident. (A court would probably find the first assumption *more* reasonable.)

You haven't noticed how eagerly companies are going after intellectual property "violations" these days, have you? (Consider SCO, which is suing everyone they can on what are appearing to be *very* shaky legal grounds.) Me, I'd be *very* wary of using that code verbatim unless I saw express permission allowing it.
