That doesn't follow. It's entirely reasonable for ADC to restrict the
attendance to a space-limited panel to ADC members simply to reduce
competition for the seating.
If anything, it's evidence that Tiger *will* be out by then: the
panel is
open to *all* ADC members, not just paid ones.
That doesn't necessarily follow either. Apple Australia are doing a
series of WWDC sneak previews.

Attendance is open to *all* ADC members and includes talk of Tiger,
and unless Tiger is released in the next 7 hours, the Sydney show will
be pre Tiger release.
Either whatever they're
saying is generic enough that no "trade secrets" are revealed, or
Tiger will
be public by then, making the NDA obsolete.
Even free ADC members are bound by an NDA. At the bottom of the above
