trashing files didn't work

I found that by restarting the server it allows you to
empty the trash afterward. Weird. And worse, there are
files on the server 10.2.6 or on the client locally
booted in 10.2.6 that I can't delete either and by
using the terminal to remove the file it won't work
either.
It's so annoying.
Anyone can provide a solid solution for this please
help.
Thanks.
