On 10.4.x and probably 10.3.x once the file vault volume is mounted, root
has access to these files, I guess that this is the same under 10.5.x. It
should be possible to configrue time machine to use the the mounted file
vault volume as the source volume. Doing this may mean that have to make a
trade off with the current version of time machine.
If you would like to backup a file vault volume (not using time machine)
other options are availible.
The time machine restore interface feels very intutituve to me.
