Apple's usual policy *is* that only Select and Premiere ADC members get beta copies of things, so in treating Panther and Xcode that way, Apple is simply doing business as usual. This isn't actually all that odd, considering that Select and Premiere members are the only people Apple usually sends *anything* to. (The various Java betas are the exception that proves the rule.) WWDC is a creature unto itself, and attendees often get things not available to the masses who haven't forked over the cash for it, or get them before everyone else. (And a Select membership isn't all *that* expensive--$500. Any developer who's serious about keeping up with all the latest Apple doings should probably have one.)

All that being said, I don't think Apple has expressly said that the betas *won't* be available by download (although they'd be really, really big downloads). Nor have they said that people subscribing to the ADC Developer CD mailing won't get them. Unless Apple says that the prerelease *will* be available those ways, I wouldn't count on it, but they haven't been completely ruled out.
