I generall have to restart the agent via kickstart. I don't know the synatx or of it changed in 3 from 2.2, but sending a unix command to:
/System/Library/CoreServices/RemoteManagement/ARDAgent.app/Contents/Resources/kickstart -activate -restart -agent
