Power Management in System Preferences and USB

Hello,

I've established that for some reason my USB device will not work properly whenever a user runs it on a powerbook with the Processor Performance set to "Automatic" in the System Preferences->Energy Saver. When this is set to "Highest", then everything runs smoothly. Is there any way that I can check this setting programmatically? I've included plenty of warnings about this but users have a way of not reading anything.
