Carbon CFM application is the observer, Carbon applications are being watched. Watched Cocoa applications did not have this problem. This was true on 10.2. I have not allowed the situation to occur since then. I do admit I have not read the release notes of 10.2.1 and 10.2.2. It seemed like it was all wrapped up in the can't remove observers crash.
I will go back and test again on 10.2.1 and 10.2.2.

I tried observing Carbon apps and CFM apps and no crash.

I don't think anything has changed in this area in the updates. If you can repro the crash please write it up.
