FileMaker file is not opening correctly

NEWBIE!
Currently, I'm using QuicKeys to trigger an AppleScript that launches a file in FileMaker Pro. The problem right now is that if FileMaker Pro has NOT been previously opened, then it seems not to activate correctly - FMP will stay in the background - and the file that was to be opened shows the error : the document MENU.fp7 could not be opened. FileMaker Pro advanced cannot open files in the “FileMaker document” format.
If FileMaker is already open (but not the file), it will correctly activate and load the file.
you'll notice that in version 2 - -- the 1st three lines seem to help
Q: is there a way to check to see if FileMaker is open or not? is there a way to fix this issue?
