I have built a new version of the login banner and it’s working great on Mac OS X 10.5. I’m looking in to how to get it posted for anyone to use. If you don’t mind waiting a little bit for our review and release process to complete. I’m not sure how long it will take since I’ve never done it before.
If your interested please let me know and I’ll contact you once I have more info.

I can see when the banner window first opens that it is has scope because the OK button shows as blue (I set it to be = to the return key) and then loginwindow appears behind it and the button turns white (as it is no longer the equivalent of the return key).

Sounds like you compiled it as "Development" for "Active Build Configuration" and not "Deployment" mode as would need to be done here.
