It's not that you must go through AT&T; it's that only the 3G version of the iPad hardware has GPS capability at all, probably because the 3G chipset is where the GPS functionality comes from.
You don't *need* to go through AT&T (or any other carrier) to use this functionality; but on devices set up with Assisted GPS (A-GPS), getting a GPS fix is a lot quicker (seconds versus minutes) if the cellular network is present.
On the iPad (and iPhone 3G/3GS), Apple uses a combination of Wi-Fi triangulation, cellular triangulation, and genuine GPS to provide a location fix. The fix starts out fairly broad and over time can become pretty much as accurate as any handheld GPS receiver.
