That article states sending the data is an opt-in process, you have to give consent, the data is anonymous and not tied to specific devices or users. Apple is building their own location database -- to do that, all they need to know is "In these locations, an iPhone identified these WiFi access points." That's different from "Lee's iPhone stopped for at Third and Pine this morning at 0715, and he went to First and Oak 15 minutes later."
