note for Yosemite update:
if you use PolicyBanner.rtfd so that you can have an image in it,
it never displays and you cannot login to the console.
reverting to a plain .txt file solved this.

Yep, same issue here as well. It would be nice if a user could just hit enter instead of having to click the accept button. Unchecking all of the Mission Control options seems to help, but it still happens randomly on some Macs.
The banner also causes issues for unattended system updates that require a reboot. The computer will boot to a black screen with a mouse and nothing else. Rebooting the computer into single user mode and removing the banner, then rebooting again, will allow it to boot to the 'installing updates' screen.

We've seen the same behavior. But clicking around the general location of the accept button you can actually (by luck) hit it and continue. So the banner is actually there but not displaying.
