Yes, "Darwin", technically, still is open source, since Darwin is a strategy that represented the act of open sourcing many key components of the OS. That is still true.

Darwin is an OS, and in order to be FOSS all the components of the OS must be buildable from freely available source code. That is not the case for the current version, although it is true of some earlier versions. One might say that Darwin is no longer open source, but the older versions still are.
