But I guess this is the wrong mailing list to ask, since the question is mainly (only) related to laws and regulations in the different countries, not (at all) related to development. And even if someone would reply 'its totally legal', would you based on that advise distribute SetFile? And risk getting sued, or even fined? Not to discredit anyone on this mailing list, but legal advice is (like coding advice, too) something you need experts for :-)
Have you read XCode EULA? Does it say something about distribution?

I suppose I figured that someone from Apple might be on this list and chime in with an authoritative comments. Indeed it would be interesting to read BUT if one can simply build the binary as you suggest then I suppose there is no need to worry.
