Weird. I wonder if this has something to do with temporary caches remembering that the new version was installed once already during this session. If so, then maybe this is a reasonable solution for the typical installation scenario, where it gets installed only once.

It might also be that touch works if the Get Info window is not sitting around open, but fails if it is.

That sounds likely to me, but I never got ambitious enough to test it.

I never leave the Get Info window open, so that definitely is not the cause.
