It could be the intermediate certificate(s) is/are already integrated in Mountain Lion (since it's the official version that supports Gatekeeper but I don't have a clean install OS X 10.8 system to verify this claim). As I wrote in another thread (Signing of packages and installation failures) I signed packages with PackageMaker and then tested them on ML with spctl tool. The packages were successfully accepted. How did spctl accept packages without intermediate certificates ? It is still not clear.

You have to use the productsign command line tool to sign a package made with PackageMaker when signing it for Gatekeeper (so that required intermediate certificates get embedded).
The command line is easy to use.
The only inconvenience somehow (in my opinion) is that you have to use a different file name for the output.
