Excellent point. However, in the side by side monitors case say you get a full height window created on the screen containing the menubar. I'm not clear if that window's title bar (which also contains the traffic lights) will be accessible so you may not be able to close the window or get at the title bar to drag it to a different location. I do agree with you that it should be a preference setting. However, I'd vote for the DEFAULT being that the menu bar height be excluded because that's inherently safe. In my case, I was presented with a form containing a checkbox I couldn't check. In your case, you could get a window that you can't move around.

Thinking about it, I'm not clear this would have helped me. If the new window is limited to the maximum screen size then (because it's top was just below the menubar) I still would not have been able to access the resize handle on the bottom right, nor the hidden checkbox below the screen.
And there's still that bug about dragging the titlebar against the menubar and the window unexpectedly jumping to the other monitor...
