VO reads my checkbox always as unchecked

Dear AX list members,

I've occurred a strange problem where VoiceOver always improperly reads my custom checkbox as "Tab to transients, unchecked checkbox". Is this a (known) bug or have I done something wrong?

The control is a user pane that mimics checkbox behavior and the output visible with AI follows. AV does not report anything wrong about this control:
