BUG ? kCGDesktopWindowLevel and Expose

I just found something weird, I did a small project to eliminate lots of causes, and I still have the same problem :

If an application opening kCGDesktopWindowLevel windows is running, exposing application's windows (not all the windows) does NOT fade all other windows, but just the desktop.
