I think that nib files saved in the "10.2 or later" format should work
on all versions of Mac OS X 10.2 and later, including pre-10.2.6
versions, but I can't say for sure.

The bug will most likely still be there if they don't upgrade,
regardless of if you upgrade the nib file or not. It's a free upgrade,
so IMO you can require that they upgrade in order to have a "supported
configuration".
