I totally agree with Michael. This is what I hate with Windows, and what I love with OS X.

Can you tell us a little bit more about the two kinds of documents? That could be helpful when trying to find an alternative way. You could also ask yourself if it really is a good idea to have two very different kinds of documents in one application.

Sounds like a Windows UI to me. Disappearing menus/menu items are a huge problem for end users. I suggest rethinking your application's flow and designing another method of managing commands for the user. Just about every kind of application has been made at some point in the past, so check out apps similar to yours to see how others do it.
