So not that unusual really ... also Dashboard works the same way, dock
icon with no menu.

You don't - because no other app work like this, and it will be very
strange for the user when they have a dock icon that does nothing
when clicked.
You have to decide what type of app you want - regular app with a
menu and a dock icon or background app that run without a dock or
menu.
