Yes the miniplayer window has always had the vertical dots.
This was always an example of deviation from the HIG.
For the miniplayer, at least, it made some sense.

As for building your own custom windows, check out one of the Stickies sample code projects for examples on how to implement custom windows and controls, but please be sure to only do so if it really makes sense for the app and the user and avoid causing user confusion with the application.
Conventional paradigms are best for the user and easier to support for the developer ;)
