That is because you are modify them in the wrong spot :)

If you copy the templates you want to modify to live under
~/Library/Application Support/Apple/Developer Tools/... and modify
them in that location then Xcode will find them and the Xcode Tools
installer wont overwrite them.

I personally copied many file templates to that location (under File
Templates/<company name>) and modified them to contain our standard
copyright, etc. information.
