Apple menu anomaly

Most target applications correctly return all of the Apple menu's menu items
when I get the children of the Apple menu, even if the target application is
not frontmost. However, a Cocoa application that I wrote a while ago does
not -- it reports 0 children. However, if I force my target application to
the front and send its Apple menu a Pick action to open it, thereafter the
accessibility API sees all of its menu items.
Is there something I was supposed to do in my Cocoa application (the target
application) that would make its Apple menu items visible to the
accessibility API without first having to expose it, like all the other
applications (Cocoa and Carbon) I've tested?
In writing as assistive application, should I expect similar behavior fairly
often from other target applications?
