I assume your application also shows up in the Application Chooser (control-option-F1-F1)?  
You can override the AXWindows and AXChildren attributes of your application class.  You may also want to do the same for AXMainWindow and AXFocusedWindow to exclude this transparent window.    But if there are information displayed in this window, make sure these window attributes are returning the window correctly.  Also take note of the possible AX window notifications associated with window appearing/disappearing.   You don't want VoiceOver cursor to auto jump to this transparent window if a mouse click occurs in the window.

We wrote an assistive application which displays information on screen, the window is set to CGShieldingWindowLevel, takes the entire screen and is mostly transparent.  To the user, unless information is displayed into the window, the desktop looks exactly the same, until they use the Ctrl+Option+F2 command to bring up the Window Chooser menu at which point our window shows up in the menu; which seems to be confusing to the user since when they select it nothing visible changes on screen.
