It seems fixed to me; if you command-click on the title of a *background*
window, you drag the window without moving it to the front. if you
command-click on a foreground window, you display the menu, just like
with a Finder window, and can then open any of the folders shown in that
menu. Also, if you click ond hold on the icon to the left of the window
title of the foreground window, it lets you drag the window's Finder
icon, just like with a Finder window.
