timeout or pause

If possible, have the previous process which writes the file (and which may be keeping the file busy in the process) write one level deeper into another folder, say ".temp", moving the file up one level to the target folder when the process is complete -- in so doing all files at the level you're looking at should not be busy, ever.

As a general rule if all our processes did this, there would seldom be the need to check whether the file is busy.
