Back up error

I have a backup script that has started giving this intermittent error
"because *Ox/it/* contains items that are in use"
The line that it errors on is (set locked of every file of every folder of
entire contents of the trash to false) has anyone any idea what the error
means? If I empty the trash manually and run the script all is fine.
