Applescript and ImageReady

Has anyone tried to open a file in ImageReady 3 via Applescript? Every time I try this Photoshop opens the file instead.

Here is a bit of irony, if Photoshop 6 is closed then the script not only launches Photoshop 6 but it launches it with the menu bar intact. I posted a related message earlier about Photoshop 6 not opening with the menu bar and some people mentioned that it was a bug with PS 6. Now it opens when I don't want it to...with the menu bar!?!
