AppleScript application not finding Finder

A beta tester of my AS app reports that on his system, it's finding a beta
release of some Apple software under NDA rather than the Finder in the tell
finder block, and immediately breaking. I've never seen tell application
"Finder" break before -- any workarounds I can put into my script?
